Introduction
1.1 These terms govern how you will work with Rose Education C.I.C, a company registered in England and Wales with company number 13808055 (herein referred to as ‘Rose Education’ or ‘us’) when providing tutoring services to students.
1.2 Rose Education, is committed to providing the highest levels of education, safeguarding and standards for all its students and expects the same from its tutors.
Applying to provide Tutoring Services for Rose Education,
2.1 By applying to Rose Education,to provide tutoring services, you agree to comply with these terms.
2.2 As part of the selection process, you will be required to supply Rose Education, with an up to date CV, an enhanced DBS certificate which has been awarded within the last year as well as two written references from an employer or someone who is not related to you.
2.3 Following the selection process, Rose Education,will have absolute discretion to decide if you qualify as a tutor.
2.4 If selected, you understand that you will work with Rose Education ],as an independent contractor and nothing in these terms shall render you as an employee, agent or partner of Rose Education,and you shall not hold yourself out as such.
Tutor Obligations
3.1 When providing tutoring services to students, you must comply with any requirements set out by Rose Education, in these terms to ensure a high-level learning experience for students.
3.2 You agree to:
(a) Provide tutoring services in good faith, to the best of your abilities and at all times act with the highest professional standards.
(b) Initiate tutoring sessions promptly, be fully prepared for the session and end the session on time.
(c) Only conduct tutoring sessions at the designated times and dates as provided by Rose Education.
(d) Be dressed appropriately for tutoring sessions, in a manner that would be suitable for attendance in a school environment.
(e) Ensure your mobile phone and other devices are switched to silent mode so that tutoring sessions may be conducted without distraction.
(f) Assume all responsibility for the provision of tutoring services, including lesson preparation, set up of tutoring sessions and lesson content.
(g) Let Rose Education know as soon as possible if your circumstances change and you are unable to fulfil a booked tutoring session.
(h) Keep in good working order equipment required for you to provide tutoring services, including personal computer, headset and any other technical equipment. You must also ensure you have a reliable internet service.
(i) Keep any information provided by you to Rose Education accurate and up to date.
(j) Value and take all students’ contributions seriously.
(k) Respond to students’ queries promptly and appropriately.
(l) Maintain the privacy of client’s personal information.
(m) Take every precaution to ensure that you have a safe working environment and ensure that you have the correct insurance policies to cover the work you undertake.
3.3 You understand that Rose Education may monitor tutoring sessions from time to time by way of review.
Rose Education’s Obligations
4.1 Rose Education will provide support, guidance and other services as required in these terms of engagement.
4.2 Rose Education will provide you with all the information required to enable you to provide the tutoring services.
4.3 Rose Education will endeavour to provide you with as many tutoring sessions as you wish to take but is under no obligation to provide you with any tutoring sessions or regular tutoring sessions.
Fees and Payments
5.1 Rose Education will collect payment for tutoring sessions from clients.
5.2 You should keep a record of tutoring sessions you have conducted and submit an invoice to Rose Education on a monthly basis.
5.3 Rose Education will pay you the agreed tutor fees, less any charges or deductions as agreed in accordance with these terms.
5.4 Payment of tutor fees will be made within 20 working days of receipt of the invoice.
5.5 You confirm that you are self-employed and are directly responsible to HMRC for all tax and national insurance contribution matters. You agree to fully indemnify Rose Education for any demands or claims by HMRC arising out of your failure to account properly for liabilities to HMRC.
5.6 You understand that you are not entitled to any additional holiday pay or benefits.
Cancellations
6.1 If you are unable to provide a tutoring session due to illness or injury, you should notify us as soon as possible so that alternative provision may be made.
6.2 If you fail to attend a tutoring session without having cancelled it and without good reason, you will not receive the tutor fees and you will not be offered future opportunities.
Safeguarding
7.1 Rose Education is committed to promoting safeguarding and expects you to act in the best interests of the student at all times and to ensure the safety and welfare of students accessing tutoring sessions.
7.2 As a tutor for Rose Education, you have a duty of care to safeguard your students and promote their welfare.
7.3 You will be expected to make yourself available for training on safeguarding and related roles and responsibilities.
7.4 If a student raises a concern, you should always be willing to listen and deal with concerns appropriately and effectively.
7.5 You shall ensure that, while conducting a tutoring session, no inappropriate images or documentation are accessible or visible by the student.
7.6 All students will be treated fairly and without prejudice or discrimination.
7.7 You will ensure that no inappropriate, offensive or discriminatory language is used during tutoring sessions.
7.8 You will not record or take screenshots of any tutoring session and will ensure that students do the same.
7.9 You will not make any improper suggestions to a student.
7.10 You will not send unsolicited communications to the student or their parent/guardian and will ensure that any contact or communication is appropriate to your role as a tutor.
7.11 If no parent/guardian is present during a tutoring session, you shall ensure that the student is comfortable to continue the session.
7.12 If you have any concerns regarding inappropriate behaviour, abuse or illegal activity, you should report it to the designated safeguarding contact at Rose Education and/or the police.
Behaviour
8.1 You are responsible for dealing with any mild inappropriate or bad behaviour in tutoring sessions but should terminate the session and report it to Rose Education if the behaviour continues to persist or is of a serious nature.
8.2 In the case of inappropriate language from a student, you should, in the first instance, request that the student refrains from doing so. If the inappropriate language continues, you should explain that you will terminate the session and report the matter to Rose Education.
Feedback and Appraisal
9.1 Clients will be encouraged to leave a review about the tutoring session and Rose Education will use this feedback to assess you.
9.2 Tutors will be expected to attend an appraisal meeting twice a year where performance and feedback will be discussed.
9.3 Rewards will be given to tutors who consistently receive positive feedback from clients.
9.4 If you receive negative feedback on more than one occasion, you will be subject to disciplinary proceedings and a grievance may be raised against you and recorded on your file. Additional disciplinary action may lead to you not being allocated any further tutoring sessions.
Non-disclosure and Confidentiality
10.1 You agree that you will not use for yourself, disclose to or share with anyone else any confidential information or course material obtained as a result of working for Rose Education, either during or at any time after your period of providing tutoring services for Rose Education.
10.2 You will exercise the utmost discretion regarding work carried out for Rose Education and will not discuss a student or tutor session with anyone other than Rose Education staff.
Data Protection and Privacy
11.1 When you register or apply to be a tutor with us, we will ask you for personal information in order to process your application. These details will include your contact details, educational background and qualifications, your tutoring subjects, your profile picture and your gender. We will also keep on file the references you submit, your CV and your DBS certificate number.
11.2 We will use this information to enable us to put you in touch with clients and to fulfil our contract with you.
11.3 We will require you to provide us with financial information such as nominated bank account so that we can arrange payment of your fees.

Termination
12.1 Should you no longer wish to work with Rose Education, you may terminate these terms by providing Rose Education with at least one month’s written notice.
12.2 Rose Education may terminate the contract immediately in the case of serious misconduct or if you are in material breach of any of your obligations under these terms.
12.3 Upon termination, you must return to Rose Education any original or copy documents provided to you in connection with the provision of the tutoring sessions including lesson plans or teaching materials. You also undertake to delete any such documents which are stored on your personal equipment.
12.4 Upon termination, Rose Education will have no liability to make any further payment to you, other than in respect of fees already accrued at the date of termination.
Non-solicitation
13.1 You agree that you will not solicit, approach or otherwise attempt to entice away any client of Rose Education either directly or indirectly or for the benefit of a third party either prior to the termination of these terms, nor for a period of 12 months following termination.
13.2 You understand that you may be held responsible for damages suffered by Rose Education if you act in breach of this clause.
General
14.1 These terms of engagement and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
14.2 Each party agrees that the courts of England and Wales shall have the exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms of engagement.
